Iain Macdonald
Iain read law at Merton College, Oxford and was called (Middle Temple) in 1996.
He specialises in consumer law, in particular in the areas of trading standards, food law and consumer credit. He regularly acts both for businesses and regulatory agencies in this area. He has a particular interest in the Enterprise Act 2002 and has advised and represented local authorities and government agencies on applications for enforcement orders under the Act.
Reported cases include:
R v. Higgs [2009] 1 W.L.R. 73. Iain acted for the prosecution (Bristol City Council) in the Court of Appeal on an appeal on a point of law following the conviction of a supplier of “modchips” under the Copyright Designs and Patents Act 1988 after a two week Crown Court trial.
Office of Fair Trading v. Lloyds TSB and others [2006] 2 All ER 821 9 (Court of Appeal); [2007] UKHL 48 (House of Lords). Iain acted for American Express in the Court of Appeal and the House of Lords opposing the OFT’s application for a declaration that s.75 of the Consumer Credit Act 1974 applies to credit card transactions overseas.
Harlow District Council v. Greene King Plc [2004] 2 All ER 102. Iain acted for Harlow DC in the Divisional Court in a case concerning the issue of whether a holding company could be a “proprietor” of a food business.
Nottingham City Council v. Wolverhampton & Dudley Breweries Ltd. [2004] 1 QB 1274. Iain acted for the City Council in the Divisional Court in a case concerning whether the owner of licensed premises, rather than the licensee, could “sell” alcohol for the purposes of the Food Safety Act 1990.

Iain is co-author of Food Standards Regulation: The New Law (published Jordans, 2000). He regularly gives lectures at the Trading Standards Institute annual conference, contributes to training days provided by the Chartered Institute of Environmental Health and gives lectures for independent CPD course providers.
Iain has three young children and is a school governor. He enjoys most sports, particularly cricket, although more often from the armchair than the pitch.
