Stephen Neville
Stephen Neville has been a member of Gough Square Chambers since 1987, and has now specialised in Financial Services and Contract Law for more than 20 years.
Over the past few years, he has been sole counsel advising in many of the largest acquisitions in the consumer lending sector, and has drafted, or advised on, documentation for a wide range of innovative financial and consumer products.
He is co-author of "Atkins Court Forms" volume on "Consumer Credit" (published October 2008) and "The Law of Consumer Credit and Hire" (OUP - published March 2009).
He has also been active in contract litigation, and in making representations to the Treasury, Ofcom and the ASA. Cases in which he has been involved include: Carey v HSBC Bank plc [2009] EWHC 3417 (test cases on enforceability of credit card debts); Bank of Scotland v Euclidian (Nos 1-10) Ltd [2007] EWHC 1732 (Com) (liability under a £12m litigation finance indemnity, and drafting of notice of cancellation rights where linked policy of insurance) - Counsel instructed for Euclidian in the appeal to the CA. Goshawk Dedicated (No 2) Ltd v Bank of Scotland [2006] 2 All ER 610 (Com - efficacy of £140m of Accident Group agreements) - Counsel advising the Accident Group and its successors. Zaman v Zoha [2005] (CA - enforceability of charge transferred to partner on his discharge of a partnership debt Shore Canarias and Interleisure v Scott [2005] (QB - efficacy of exclusion clauses in timeshare contracts) McMillan Williams v Range [2004] 1 WLR 1858 (CA - on the applicability of the Consumer Credit Act 1974 to advance payments of commission) Altuntas v Safestore Trading Ltd [2003] EWHC 49 (QB - on declarations of value in storage contracts); Rahman v Sterling Credit [2001] 1 WLR 496 (CA - time bar on extortionate credit bargain applications) and Sterling Credit v Rahman [2002] EWHC 3008 (Ch - on the implied obligation to reduce rates of variable rate loan)
He studied law at St. John’s College, Cambridge from 1979 to 1982, winning the McMahon Scholarship for his academic results. After graduating, he travelled widely in Asia and Latin America, was called to the Bar in 1986
He is recommended as a Leading Junior in both the Chambers and Partners Directory and the Legal 500.
