Stephen Neville

Stephen read law at St. John’s College, Cambridge between 1979 and 1982. Whilst there, he won the McMahon Scholarship. After travelling widely in Asia and Latin America during the 3 years following graduation, he was called to the Bar in 1986, and joined Gough Square Chambers in 1987.

Since 1987 he has specialised in Financial and Commercial Law. He attracts a considerable volume of high quality financial services and consumer credit work, and has advised on a wide range of innovative products. He regularly drafts agreements, and provides reviews for the purposes of proposed company acquisition or portfolio securitisation. Highlights of the last 12 months have included being sole counsel advising in two of the largest acquisitions of the year in the consumer lending sector, and leading successful negotiations with the Treasury for the granting of FSMA exemption to a non departmental public body.

He is recommended as a "leading junior" in both the Legal 500 and Chambers and Partners legal directories, the former describing him as "impressively knowledgeable and experienced" (2007 edition), the latter stating that he had “won the favour of solicitors for his user-friendliness, collaborative style, quick turn around times and knowledge of consumer credit” (2006 edition).

Sterling Credit v Rahman [2002] EWHC 3008 (Ch – on the implied obligation to reduce rates of variable rate loan)

(QB – on declarations of value in storage contracts); McMillan Williams v Range [2004] 1 WLR 1858 (CA - on the applicability of the Consumer Credit Act 1974 to advance payments of commission)

Shore Canarias and Interleisure v Scott [2005]
(QB – efficacy of exclusion clauses in timeshare contracts)

Rankine v Barclays Bank plc [2005] (Ch – effect of loss of original credit card agreement)

Zaman v Zoha [2005] (CA – claim by partner to enforce charge transferred to him on his discharging a debt owed by partnership).

Goshawk Dedicated (No 2) Ltd v Bank of Scotland [2006] 2 All ER 610 (Com - efficacy of Accident Group agreements. Counsel advising the Accident Group and its successors).

He is counsel for the Appellants in the case of Bank of Scotland v Euclidian (No 1) Ltd (due to be heard in the CA early in 2008).

Stephen is co-author with Julia Smith of “Atkins Court Forms” on Consumer Credit (new edition due 2008).

He gives occasional lectures on consumer credit issues and standard contract terms, and has written a number of articles for the All England Legal Opinion and other journals, covering subjects such as Internet Shopping, the Unfair Terms in Consumer Contracts Regulations, Variable and Concessionary Interest Rates, Extortionate Credit Bargains, Unenforceable Second Mortgages, Auctions without reserve, and Auctioneer’s Liability for Conversion.
